Filling the Gap Policies for Students, Parents, and Legal Guardians:

We are so excited to welcome you to the Filling the Gap NYC family! By using our services, you are agreeing to the following, which make sure that you understand what we do and the terms of our services.

  1. Filling the Gap is a tutoring service that matches tutors with students. The tutors are not employed by Filling the Gap; they are independent contractors. Filling the Gap interviews all tutors in an effort to gauge their talents and experience in order to find the best match for your students. But you should be aware that we rely on the information prospective tutors provide to us in the interview process. We do not perform background checks or confirm the information prospective tutors provide to us. We also do not monitor the interactions between student and tutor, and rely on the tutors to perform their services in a professional manner and to comply with our policies and the law. Any views or opinions expressed by a tutor reflect only their views and opinions, and do not reflect the views or opinions of Filling the Gap or its organizers.
  2. Filling the Gap is not a child care service. To the extent tutors come to your home for tutoring, Parents and Legal Guardians need to have an adult in the home to provide child care for the students. During in-home tutoring sessions, students, parents and legal guardians also need to take appropriate measures to protect themselves from the risks of COVID-19 and otherwise safeguard their health and safety. During all tutoring interactions, students, parents and legal guardians are required to wear face coverings, wash their hands, avoid close contact, and follow other guidelines published by the Centers for Disease Control. Students, parents and legal guardians understand that Filling the Gap is not taking any measures to protect them from any health risk and assume all risks of engaging in contact with tutors.
  3. Students, parents and legal guardians agree not to record any tutoring session without the express written permission of both the tutor and the parent or legal guardian.
  4. Filling the Gap values feedback from students, parents and legal guardians about their tutoring experiences. Students, parents and legal guardians agree to report any concerns they have about their interactions with their tutors.
  5. During your experience with Filling the Gap and the tutors, you will be providing us with information about your student and family, including your names, email addresses, phone numbers and information about your student’s academic abilities. We will use that information to further our mission of providing you with great tutoring. You should also be aware that we may disclose your information where legally required to do so. In addition, if a student reports to Filling the Gap or the tutor anything that involves a threat to safety, Filling the Gap may reach out to relevant government agencies and may provide personal information as needed.
  6. By using our service, you assume full responsibility for any risk of loss, property damage, or personal injury that may be sustained by me or my child as a result of or that is in any way related to my or my child’s participation in Filling the Gap. You and your student release from liability, waive, discharge and covenant not to sue Filling the Gap, and any of its organizers, representatives and tutors from any liability, claim and/or cause of action arising out of or related to any loss, damage or injury, arising out of or resulting from my child’s participation in Filling the Gap.

Filling the Gap Policies for Tutors:

We are so excited to welcome you to the Filling the Gap family! By participating in Filling the Gap’s services, you are agreeing to the following:

  1. Tutors will be completely honest with Filling the Gap about their backgrounds, experience and abilities.
  2. Once matched with a student, Tutors agree to work with that assigned student at least through the end of the student’s current semester.
  3. Tutors will not record any meeting with their students without the express and written permission of those students and their legal guardians. Any recordings that are made will be made only at students’ and parent/guardians’ requests and will not be made available to anyone other than the student and parent/guardian.
  4. Tutors are responsible for their own health and safety, and will take appropriate measures to protect themselves from the risks of COVID-19 and any other disease or risk to their health. Tutors will wear face coverings, wash their hands, avoid close contact, and follow other guidelines published by the Center for Disease Control. Tutors understand that Filling the Gap is not taking any measures to protect them from any health risk and tutors assume all risks of engaging in any contact associated with their tutoring assignments.
  5. Tutors will not share content with students that contains sexual images, vulgarity, graphic violence, threats, hate speech, or incitements to violence.
  6. Tutors are not, to their knowledge, restricted by judicial decree, court order, or other legal restriction from interacting directly with minors.
  7. Tutors will submit the hours they worked at the end of each week through a Google Form that Filling the Gap will send to them. Submitting falsified hours may result in termination.
  8. Tutors may be terminated from the program at any time at the discretion of Filling the Gap.
  9. By working with Filling the Gap, tutors assume full responsibility for any risk of loss, property damage, or personal injury that may be sustained as a result of or that is in any way related to participation in Filling the Gap. Tutors release from liability, waive, discharge and covenant not to sue Filling the Gap, and any of its organizers, representatives and tutors from any liability, claim and/or cause of action arising out of or related to any loss, damage or injury, arising out of or resulting from participation in Filling the Gap.
